3. Customer Responsibilities
By booking our Services, you agree to:
- Have all items properly packed and ready for transport before the crew arrives, unless packing services are explicitly included in your booking agreement.
- Provide safe, clear, and unobstructed access to both origin and destination properties, including elevators, stairways, parking areas, and any necessary building permissions or approvals.
- Inform us in advance of any fragile, high-value, oversized, or otherwise specially handled items that require additional care or equipment.
- Adhere to all applicable laws, local regulations, and building-specific rules that apply to your move.
- Confirm that you are the legal owner of all items being transported, or that you hold express authorization from the owner to arrange their transport on their behalf.
4. Exclusions and Prohibited Items
We reserve the right to decline transportation of certain items, which include but are not limited to:
- Hazardous, flammable, explosive, or chemically reactive materials
- Illegal substances or any items whose transport is prohibited under applicable law
- Perishable food items, live animals, or live plants, unless explicitly agreed upon in writing prior to the move
Should prohibited items be included in a shipment without our prior knowledge, you will bear full responsibility for any damages, regulatory fines, or penalties that arise as a result.
5. Payment Terms
Payment terms are as specified in your estimate or booking confirmation. Unless otherwise agreed in writing, a deposit is generally required before the move proceeds, with the remaining balance due upon completion of the Services.
Additional charges may apply for services or conditions not covered in the original quote — including but not limited to extra labor, long carries, stair fees, additional stops, extended waiting time, or significant changes to the inventory.
If payment is not received by the agreed due date, late fees may be assessed and, where permitted by applicable law, we may withhold release of your goods until all outstanding balances are settled in full.
6. Cancellations and Rescheduling
All cancellations and rescheduling requests are subject to the notice requirements and fee structures outlined in your estimate, booking confirmation, or our current cancellation policy.
Cancellations or changes made with insufficient notice may result in partial or full forfeiture of any deposit paid, as well as additional fees to recover costs we have already incurred.
In situations beyond our reasonable control — such as severe weather events, unsafe operating conditions, or mechanical failure — we may need to cancel or reschedule your move. We will notify you as quickly as possible in such cases and work with you to arrange a suitable alternative date or solution.
7. Liability for Loss or Damage
Our liability for any loss of or damage to your goods is limited as permitted under applicable law and as further defined in the specific terms of your estimate or bill of lading.
You are required to inspect all items upon delivery and record any visible damage on the delivery documentation before signing. Claims for damage that was not immediately apparent must be submitted to us in writing within the timeframe specified in your move documents.
The scope of our liability may vary depending on the valuation coverage option selected at the time of booking. Additional protection plans may be available for an added fee. We are not responsible for damage attributable to events outside our reasonable control, including natural disasters, extreme weather conditions, or pre-existing defects in your items.
8. Limitation of Liability
To the fullest extent permitted under applicable law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, lost data, or missed business opportunities, however caused.
- Our total cumulative liability under these Terms or in connection with any Service shall not exceed the amount you actually paid to Creative Moving Solutions for the specific move or service from which the claim originates.
